I my code I have re-added the form (with tabs) via ajax on dialog open
this is why tabs behavior was dropped
i have changed
target.add(form)
with
target.add(form.add(new JQueryUIBehavior("#tabs", "tabs"))
and now everything works as expected
dumb error
