The 2.4.8 kernel uses the v4l drivers (unless you want to patch it). The 2.4.17 kernel may very well use v4l2. Perhaps not all of the functionality of v4l is ported to v4l2 for that driver (xawtv can use either, and will prefer v4l2 unless otherwise specified). I don't know which version the kernel driver for your hardware supports.
