I do not know the site. The copy would be legal in the US since anything prior to 1923 is PD, however in many cases films made before that are in fact copyrighted by "special contents" so for instance all the versions of silent films put out by Milestone, Flicker Alley, Kino etc are copyrighted which in most cases is because of the music score. It seems unlikely to me that this copy would have a copyrighted score. However as Peter points out there may be a far better restored version available in the near future.
Short answer would be that this copy is legal in the US though likely not of the best quality. FYI I just looked at the site and it is a mixed bag. The majority of titles are PD but a large number are bootlegs so basically you can not trust it and would have to check title by title.
