A kerfuffle has arisen in my library about whether the right of first sale still applies toward the purchase of HBR case studies on CD-ROM if there is no additional license agreement accompanying the purchase. I had assumed that if a library orders copies and HBR fills the orders, there's an understanding that the items will circulate like other library books and videos. Have any of you run into any legal static regarding HBR case studies on CD-ROM? BTW I am aware that they limit the length of time the case studies can be used so my question is just whether even time-restricted library circulation is permissible.
