Are you sure? In a terminal logged-in as root, using vim 7.0.235:
vim -u NONE -N
:set ml? mls?
modeline
modelines=5
Modelines default off when 'compatible' is set, they default on (and 5) when
'nocompatible' is set. Root login changes nothing to that AFAICT.
