In looking over your patch, it looks like the problem was fixed earlier -- but the fix was put into a windows-only if-endif block. So, I've moved the older fix to handle all such actions (marked files move with g:netrw_keepdir == 1).

Please try netrw v172g (which you can get from my website: http://www.drchip.org/astronaut/vim/index.html#NETRW).
