Make it easy for yourself and restore the iPod back to factory settings. Go to settings general reset erase all content and settings. Then connect to iTunes to set it all up again. Next to update click the check for updates button and follow the instructions. Having said that you can do the restore totally from iTunes just by clicking the restore button which in turn will allow you to update iOS during the restore.
