The choices facing Rossi could make being "unavailable" for trial preferable to facing the music. Efforts to postpone the trial date have failed and he may be getting desperate. From the pretrial depositions and filings, his case looks weak (according to Lomax who has followed every twist and turn) and the counterclaim of Industrial Heat against AR for *Fraudulent Inducement *remains intact. That could cost millions. There is little doubt that the invented "customer" was indeed fraudulent, and probably some of the data.

Of course Rossi cannot walk away from this mess without repercussions, so the options he has are few. The one which no one talks about is illness - either real or "convenient."

Several photographs have appeared in the past few months of a frail-looking AR wearing a wig. Lomax reports that one of these wig occasions was a court hearing which could have been the one where he tried to have the counterclaim dismissed. If he is not really ill, he may be setting the stage. Nancy Grace will be sooo disappointed.
