My opinion not my client's or company's..........

1. Why is a certification required at all?
   It weeds out those that can't do EDI or can't meet at least a HIPAA
level
of competancy. It's not a HIPAA requirement but may be a requirement of
your
trading partner (at their cost). 

2. While choosing certifying vendor, what are the points one should
note?
   Your partner may require one.  Make a list of things you want.
Proven
track record, ease, good reporting, HIPAA knowledge, gaurantee backed by
finacial recourse, hand holding if you are new to EDI...

3. Do the certificates have any legal importance, so if one is certified
for one Transaction (say 837 I) then other party can not reject it
saying its non HIPAA?
   No.  If it's not HIPAA compliant then it will be rejected without
concern
as to some prior transaction being certified.  If it is compliant then
it
can't be rejected on that basis but processing can be denied if it
doesn't
meet the business needs of that entity.  Some large organizations are
paying
a certifier to check all new partners to weed out those that can't, then
paying for certification against their own guide (companion documents
with
business requirements), and only then willing to test.

4. After certification for any Transaction, if it is found that it is
not. Who is going to take the responsibility, the certifying
organization or the organization who has generated the Transaction?
   See your lawyer.  I would say the originator.  Now if your contract
with
your certifier spells out some gaurantee then you have something to go
after
them after the fact.

5. What type of guarantee do the certifying vendors give?
   Ask them.  Get it in writing.

6. Is there any penalty for the organizations who claims to be HIPAA
compliant and found not? so if there is any penalty then who is going to
pay for it?
   CMS has spelled out the penalties.  First someone has to complain.
The
originator pays.  Again, if your contract with your certfier spells out
some
gaurantee then you go after them.
