See transmittal AB-02-005 (this mentions that certain level III HCPCs and modifier codes will remain in use until December 31, 2003.
 
Here was CMS' response to my inquiry (March 2003).  I sent an inquiry to the Medicaid contact but never received a response.
 
"I work in the Division of Practitioner Claim Processing in CMS central office
in Baltimore Maryland. I was responsible for writing the Medicare Program
Memorandum, Transmittal AB-02-005 regarding Level III HCPCS Codes.

As stated above the Program Memorandum is a Medicare document.  The information
was directed towards out Medicare contractors, giving them guidance on how to
deal with eliminating Level III HCPCS codes in order to become HIPAA compliant.
The instruction applies only to Medicare contractors not all of DHHS.

Medicare contactors have been directed by CMS that HCPCS Level III codes must
stay in place until December 31, 2003.  The reason is because there was
legislation passed under BIPA which extended the use of HCPCS Level III codes
until that date.  Medicare contactors will not recognize Level III HCPCS codes
beginning January 1, 2004.

I am not sure how Medicaid is handing their local codes, whether BIPA extended
to them or not.  You may be able to direct any Medicaid questions on local codes
to David Greenberg in Medicaid.  He would probably know who in Medicaid could
help you with Medicaid local codes issues."

Alabama Medicaid has said the same thing. They referenced a recent CMS interpretation of BIPA 2000 (which I think said local codes could be used through 2003...not exactly the same timeframe as HIPAA TCS).

I have heard a rumor that the State of Indiana, Indiana Medicaid, and EDS have agreed to the use of local codes through the end of 2003, and that CMS has approved this extension.  Can anyone verify this rumor?  Have you heard anything similar in other states or on a national basis?
