See transmittal AB-02-005 (this mentions that certain level III HCPCs and modifier codes will remain in use until December 31, 2003.   Here was CMS' response to my inquiry (March 2003).  I sent an inquiry to the Medicaid contact but never received a response.   "I work in the Division of Practitioner Claim Processing in CMS central office in Baltimore Maryland. I was responsible for writing the Medicare Program Memorandum, Transmittal AB-02-005 regarding Level III HCPCS Codes. As stated above the Program Memorandum is a Medicare document.  The information was directed towards out Medicare contractors, giving them guidance on how to deal with eliminating Level III HCPCS codes in order to become HIPAA compliant. The instruction applies only to Medicare contractors not all of DHHS. Medicare contactors have been directed by CMS that HCPCS Level III codes must stay in place until December 31, 2003.  The reason is because there was legislation passed under BIPA which extended the use of HCPCS Level III codes until that date.  Medicare contactors will not recognize Level III HCPCS codes beginning January 1, 2004.
