Better how?

According to [2] it works in most AT (and note the use of <label
for=""> to both degrade gracefully and gain the "click to check"
behavior in "visual" browsers).

Note Marco is only talking about Firefox 3 and a significant selection of recent screen readers for GNOME and Windows, his test case is about individual field labels not group labels, and even there he mentions that it doesn't work with the most popular screen reader amongst those tested. LEGEND works in more user agents and AT combinations and is therefore more backwards compatible.
