I think this behavior should be specified in HTML5.

I guess that makes sense. Though I would personally prefer if we could move the HTML5 specific bits of DOM Core to Web DOM Core which then would simply state the exceptions for HTML documents. That way the methods are defined in one place which makes more sense to me.
