Not all servers will resume an interrupted D/L.
GetRight (no connection to company) lets you know right away if this is the case. It also lets you "ping" for the size, file date, and some other stuff to "see the info", and also see if the file is "actually there"...

If you restart the download, does it commence from the 38 MB?
Quite possibly the partial file has already been deleted from the cache
