We shall now stop this discussion of legalities now as we shall not solve anything because none of us are lawyers & almost none of this has been presented to the courts therefore this part of the thread is mere conjecture. I've written some of you off list asking this to stop yet you've gone behind my back to get a post to the list.

Almost everything you've typed here is an assumption. I'm not asking you to desist this time. You work for a college & not a corporation so how can you even purport to know what company policies are & even if you could you don't work for the same company as the original poster does?

Most if not all companies have a "Loaned Software" policy of which all current and former employees must agree to and abide by.

This is a great sentence. You don't know if the company he is referring to has a loaned software policy but you clearly stat that he must agree & abide by "IT". What is "IT" when you don't even know if "IT" exists?

If the employee disagrees with any item in the company policy then the loaned software request will be denied.

Again how do you know if the software was requested? You DON'T. How do you know if the company will deny the supposed request? You DON'T.

You must return the CD to the company upon termination of your employment and must not have copied it anytime prior to your termination.

For all you know he was a contract employee that worked off site. He supposedly asked the company if they wanted it back. Are you going to fly to England & enforce the policy when no one else seems to be worried about it ?

When you get your law degree then & only then can you purport to know what you're talking about in this case & even then questions about the legality of this or that is still not welcome on this list.
