Changing the name is always bad in my opinion. As we already have a pretty good arrangement with Team17 the name shouldn't cause any problems.

You could change the sprite to replace the worms with Tux (but
personnally i think that would be boring, too many games already with
Tux).
As long as we don't use any original worm graphics (which we don't) it doesn't matter whenever it's a worm you play or a pinguin.

You could change a little bit the gameplay thought that might be
impossible.
Changing the gameplay is another no no in my opinion. Adding new cool features - yes, but keep the gameplay idea of the original worms. Take a look at FreeCraft, they still use exactly the same game ideas and gameplay as the original warcraft and Blizzard has nothing against it.

I am thinking of the Freecraft project too. Their mistake was to reuse
Warcraft game graphics and to clone very strongly all the features.
As far as I know the story, the problem was the name *Craft which is a trendmark. FreeCraft itself didn't come with any original graphics. Note that with the new version of FreeCraft it is still possible to use the graphics from the original Warcraft2 CD, just as the old FreeCraft did so that obviously was not the problem.

That's if for now,
