Well yes, that's the whole point of the object element...anything inside it represents a fallback for when the object itself can't be rendered

I'd be more concerned, however, about the accessibility implications when the flash *doesn't* fail, but it nonetheless not navigable by keyboard (or, for instance, swallows the browser's focus/tab) or not exposed to any screen reader or other assistive technology.
