I believe that this has been addressed by the appropriate ebXML groups

As provided in IBM's May 16, 2002 disclosure to OASIS,
IBM will, upon written request, continue to provide a
nonexclusive, royalty free patent license, with other
reasonable terms and conditions for ALL patents issued
to IBM which contain essential claims and for which IBM
is able to provide patent licenses (including the issued
patent and unpublished patent application disclosed
above), for the OASIS ebXML Collaboration Protocol
Profiles (CPP's) and Collaboration Protocol Agreements
(CPA's) Versions 1 and 2 specifications. This patent
license is available to all entities. Should those
requesting a patent license also have essential claims
to the referenced OASIS CPPA specifications, IBM will
grant this patent license provided that the recipient,
in return, will grant IBM a reciprocal license to their
essential claim(s).
Doesn't that settle the matter?

Zahid,
Obviously, you did not feel it was satisfactory for me to take this IP
issue as an action item, and felt you needed to broadcast
it. As I said, I will look into the issue and give the group an update. I
have worked with Marty Sachs on CPP/CPA for years.
I think the group should concentrate on whether or not CPP/CPA which is not
based on WSDL or WS-Security is appropriate first.

As discussed in today's WSS-QoP there may some issues of CPP/CPA
for non-ebXML work.
However, one area of concern is that CPP/CPA have some IPR issues
due to a IBM's patent(s) in that area. E.g., please see:

Hence, although we are in exploratory phase as to whether ebXML
CPP/CPA work may be applicable in some form for future standards

Hi,
I put a ppt for ebXML CPPA with some general
introductory slides taken from previous
presentations, which is then followed by a
drilldown on how capabilities and
agreements concerning message level
envelopes (for data confidentiality)
are captured in CPA 2.0.
Other security features--
digital signature, transport security, etc--
are captured in analogous ways. There
are some other aspects in the packaging
that would reflect on-the-wire aspects of how
the security features are realized that I
did not go into in the ppt but can be
considered and discussed tomorrow.
