There is an error in the XHTML 1.0 Second Edition specification. The second sentence in the paragraph after the ordered list in section 3.1.1, which reads as follows:

"Such a declaration is required when the character encoding of the document is other than the default UTF-8 or UTF-16 and no encoding was determined by a higher-level protocol."

should read:

"Such a declaration is required when the character encoding of the document is other than the default UTF-8 or UTF-16 and no encoding was determined by a lower-level protocol."

HTTP, etc, are lower-level protocols than HTML. If an encoding has been determined by, for example, an HTTP header, then that has been determined by a lower-level protocol, not a higher-level protocol.
