A workaround would be to rewrite the path to copy the document node's
children rather than the node itself:
<xsl:copy-of select="document($file)/*" />
But I think a case can be made that copying the root node should have the
same meaning. I'd have to check the spec, but I'd be inclined to consider
that message a bug.
