Is this the standard Result Tree Fragment versus Node Set confusion? If so, it 
would be correct behavior for XSLT 1.0 and the node-set() extension would be the 
official workaround. (XSLT 2.0 removes the distinction between those two types, 
subsuming both under the concept of Temporary Trees.)
