When outputting to DOM, you *must* generate a well-formed document. The problem 
is probably not your PI (which can safely preceed the root element) but other 
content which can't (even whitespace text nodes are forbidden, by the DOM 
rules).

If you're outputting to SAX, this level of nit-picking is not performed.

If this doesn't get you on the air, ask for assistance on the Xalan list. It is 
almost certainly a usage error rather than a bug.
