Could you please provide an example of what you feel Xerces is doing incorrectly. 
We've implemented that erratum for the language type for quite some time. The pattern 
facet it is checking against is ([a-zA-Z]{1,8})(-[a-zA-Z0-9]{1,8})*. This is 
equivalent to what is in the XML Schema second edition [1].

RFC 3066 [2] defines language as:

Language-Tag = Primary-subtag *( "-" Subtag )
Primary-subtag = 1*8ALPHA
Subtag = 1*8(ALPHA / DIGIT)

That seems to me like the same thing. If there are constraints on language above and 
beyond this syntax XML Schema currently doesn't impose that.
