This is by no means a done deal. The companion bill in the House, sponsored by Rep Dobson, also calls for a one-year delay but also includes some fairly controversial features that might be difficult to pass or reconcile with the Senate. These include a requirement for every covered entity to file a plan, including budget, showing how it will get ready by Oct 2003 and a $1/claim tax on paper claims to help cover regulatory costs.
I personally think that Dobson will drop those provisions somewhere along the line and a reconciled bill will pass, but I wouldn't be surprised if it didn't happen, and I certainly wouldn't be surprised if it didn't happen until after the Christmas recess.
