I was eventually able to get it to work via:

                                <xforms:group     ref=".[not(AbsentElement)]">
                                    <xforms:trigger>
                                        <xforms:label>Add absent
element</xforms:label>
                                        ... action ..
                                    </xforms:trigger>
                                </xforms:group>
