I believe what is happening is that the form is being processed by betterform instead of XSLTForms even though i have followed the instructions and included
declare option exist:serialize "method=xhtml media-type=text/xml"; declare option exist:serialize "indent=no"; declare option exist:serialize "process-xsl-pi=no"; in my xquery.
