When the community requests information, it is not forthcoming, a year latter, information is again requested by the Federation for a Sustainable Environment on behalf of Our Communities and again with a new CRG CEO, information is not made available to the public upon request. Regrettably, my request, in terms of the provisions of the Promotion of Access to Information Act, No 2 of 2000, for the approved Environmental Management Plan, which I have submitted in the prescribed format on the 8th of March, 2009 to Mr. Johan du Toit, the CEO of CRG, was refused. As you may reflect, in terms of the PAIA, the failure by CRG to respond within 30 days constitutes a refusal. We are of the opinion that the public participation process for the amendment of the approved EMP will be fatally flawed, procedurally unfair and unreasonable and will lead to conflict and legal review under the Promotion of Administrative Justice Act, 3 of 2000 (“PAJA”) since we were refused access to the approved EMP. For the sake of clarity we wish to make the following statement of what we believe to be the basis, inter alia, for a process that will lead to meaningful and effective participation. These are by no means exhaustive and include, but are not limited to the following: 1. Sufficient information must be provided to I&AP’s in order to enable them to tender helpful informed advice and comment. 2. All the relevant documentation must be made available to I&AP’s for comment, particularly the approved EMP which CRG intends to amend. 3. We, as the I&AP’s will not be in the position to comment meaningfully on the amendment without full and exact knowledge of the contents of the approved EMP. I respectfully request you to please include this e-mail and appended document entitled “Request for Access to Record Central Rand Gold” in the comments received from I&AP’s in terms of the Public Participation Process.
