IMMEDIATE PRESS RELEASE JUSTICE COMPROMISED IS JUSTICE DENIED
Friday, September 18, 2009 For the past 19 Months Kaizer Mohau has been subjected to legal and prosecutorial violence that has led to the compromise of his democratic rights and life. While we accept the fact that even if it was an accident the law needs to take its part in ensuring that justice is applied without fear or favour, this is the context within which Kaizer Mohau has no problem with the law applying itself – however it is very problematic if political factions are used to advance injustice as it is happening in Potchefstroom. Firstly, it was the Democratic Alliance which wanted to intimidate the justice department to make it treat Mohau in a manner that advances its political agenda based on dealing with anyone who has for a longtime supported Cde Jacob Zuma. In the context of their campaign against the ANC President, the DA has conducted itself in the most racist and anti Africans conduct. But it is absolutely ironical to know that some of our leading cadres in the movement and local government are participating in this DA campaign simply because of their factional agenda and intentions. Leading cadres in local government including in the ANC Tlokwe Sub region – have had meetings with investigating officers and prosecutor to ensure that they deal with Mohau. The public safety department headed by the Sub region chairperson conducted investigations into the accident but went beyond the accident and eventually found Kaizer Mohau guilty of charges which have on Thursday, 17 September 2009 rejected by the magistrate as being wrong and dangerous – the Office of the expelled Municipal Manager released public statements in which these rejected parts were declared to be officially correct. It is in this context that Kaizer Mohau will be communicating with the National leadership and the Provincial Task Team regarding this political misconduct. When Mohau appeared in court prior to Thursday, 17 September 2009, the NPA and the magistrate argued that the state has no other witnesses, but on the 17th September the NPA called a witness who is a police Inspector known to be a DA member – this inspector compromised the law and the SAPS rules and conduct. Accordingly, the magistrate agreed that witnesses including the mentioned inspector lied about two factors; 1. Drunk and driving and 2. reckless driving – As such the magistrate dismissed their evidence in that regard but argued that the only charge to be furthered is that of calpable homicide, which she will make her final decision on the 5th of October 2009. The media Obviously the media has tried since the beginning of the case to report it very one-sidedly. An SABC radio station reported without verifying facts that Mohau did not have a driver’s licenses during the accident and this information was communicated to the radio station by the highest Office of local government. Local newspapers reported as well in a manner that publicized Mohau as having deliberately made the accident. One Community radio station lied many times to the public about the case such that we are aware that the it is being controlled by some factionalists who are leading in the Tlokwe Local Government Municiplaity. In this view we demand the investigations of the role played by our cadres by the PTT as a matter of urgency failure which Mohau will be adviced to legally challenge all those responsible, including to sue the municipality and the radio station.
