Morning Star.png Police Won't Face Charges Over Waco Biker Massacre James Tweedie, The Morning Star, London, 16 September 2016 Three Texas policemen involved in last year's Waco biker massacre will not be prosecuted after a grand jury declined to press charges on Wednesday. Swat team members Michael Bucher, Heath Jackson and Andy O'Neal will not have to account for their actions in court, despite ballistics evidence showing that the first two had shot four of the nine dead victims. The ballistics report established that four of the dead were shot with .rifle bullets used by the Swat team waiting outside the regular Texas Confederation of Clubs and Independents gathering at the Twin Peaks restaurant in Waco on May 17 2015. Waco police spokesman Sergeant Patrick Swanton said the McLennan County district attorney had asked the grand jury whether the shootings were justified - after the officers were cleared by an internal investigation. Notorious Interim Waco police chief Frank Gentsch said the officers, who were placed on paid administrative leave after the shooting, will return to full duty immediately. Mr Swanton is notorious for his unsubstantiated claim in the wake of the massacre that motorcyclists were planning revenge attacks on police with explosives and grenades. The grand jury hearing "allows the police to clean their hands" of the shooting, said Dallas attorney Don Tittle, who is representing more than a dozen bikers in lawsuits against the city. Mr Tittle added that it was "routine" for prosecutors in Texas who do not want to bring charges in an officer-involved shooting to refer the matter to a grand jury. Nine men were killed and 20 wounded in the incident, which began as an argument between members of the Bandidos and Cossacks clubs, which the state has designated as gangs. Ambulances held back Police claim that a brawl turned into a gunfight, but victims deny this, saying they came under rifle fire from a distance. Officers delayed ambulance crews gaining access to the car park after the shooting, during which time several injured victims allegedly bled to death. Most of the motorcyclists who were having breakfast in the restaurant took no part in the fight. CCTV footage shows them taking cover and fleeing after the shooting broke out. But 192 were arrested and 154 charged under draconian laws on organised crime. The last to be released on bail spent almost six months on remand.
