SATAWU not in crisis but stronger after Central Executive Committee Meeting


South African Transport and Allied Workers' Union (SATAWU) has noted with 
concern the press statement by the SA Communist Party Western Cape along with 
weekend media reports and would like to set the record straight.

There is no crisis in SATAWU. In fact, the Special Central Executive Committee 
(CEC) meeting on Friday 27 January was held to ensure absolute compliance with 
the constitution and to fill the vacancy of the Deputy General Secretary. 
Former Head of Rail and Infrastructure Zacharia Mosothoane was elected 
unopposed.

To be clear, the dismissal of one person does not equate to an organisational 
crisis. It is important to note that the former Western Cape Provincial 
Secretary Tembela Dakuse was not dismissed for calling a CEC. Dakuse was 
dismissed for several transgressions including insubordination for refusing to 
submit reports on the activities of the province to head office.

In addition, the national office is in the process of finalising the 
reinstatement of 100 workers who were dismissed as a direct result of Dakuse's 
actions.

While her disciplinary hearing was pending, Dakuse defied the conditions of her 
suspension and participated in an unconstitutional Provincial Executive 
Committee (PEC) meeting. The meeting had been convened without informing the 
National Office Bearers, as required. The money used to fund it was sourced 
from an employer without requesting the necessary permission from national 
office.

Furthermore, the PEC resolved to take SATAWU's National Office Bearers to court 
in an attempt to interdict Dakuse's suspension and the scheduled disciplinary 
hearing. However, the court ruled that the matter was not urgent.

It is for these reasons that the CEC on Friday resolved to suspend the Western 
Cape Provincial Office Bearers from their posts, pending the outcome of a 
disciplinary process.

With regards to the Eastern Cape, the CEC resolved that the province must 
convene a Special Provincial Congress, to rectify a constitutional anomaly that 
resulted during the April 2016 Special PEC.

The PEC was set to fill two vacancies but instead filled three. In terms of the 
constitution, only a Special Provincial Congress and not a PEC has powers to 
fill more than two vacancies (more than 50%).

We suspect that the reason why the SACP in the Western Cape chose not to engage 
us first but opted to go the media is because of slate politics.

We reiterate, SATAWU is not in crisis and as such we urge our alliance partners 
to respect our independence, constitutional obligations and structural 
resolutions.
