Mandatory Kannada education is violation of fundamental rights: Supreme Court News Network Bangalore, May 6: In a landmark judgement, the Supreme Court on Tuesday ruled that the government cannot impose a particular language, including mother tongue, for teaching children at the primary education level. The apex court also struck down a Karnataka government order imposing Kannada language as the medium of instruction in all primary schools of the state. A five-judge Constitution Bench, headed by Chief Justice R M Lodha said that the state cannot impose a language on a child and such a compulsion could be violative of fundamental rights of the children and their parents. This highly emotive issue is likely to create more controversy across the state. The Karnataka Government had filed an appeal against the division bench judgment of the Karnataka High Court in the Supreme Court. An association of private schools had been fighting against the imposition of Kannada as a main language or medium of instruction in primary schools. Their advocate KV Dhananjaya argued that they were not questioning the greatness of Kannada or its primacy in the state. They maintained that the knowledge of English is very essential and the children should not be deprived of it. During the hearing, advocate Dhananjay, representing more than 1,800 private unaided English medium schools in Karnataka, told the Bench how language is not ingrained in the human brain and teaching in the mother tongue in primary classes cannot do much to improve career prospects. The Government wholly errs when it assumes that a parent's preference for English medium education is a rejection and devaluation of Kannada language. Kannada is a language of immeasurable greatness. A child could learn through English medium in his school and still be perfectly wedded to Kannada culture and hold it with the greatest respect and regard, Dhananjay said. Citing the example of Nagaland where 90 per cent of the population is declared as Scheduled Tribes and English is the preferred medium of instruction, Dhananjay said, Today, 51 per cent of all children in India in the primary education system are enrolled in Hindi medium. Then comes English medium, which has 11 per cent. If English cannot be protected by the courts because it did not originate in India, what about the religions of Islam and Christianity? These religions did not originate in India. Are not these two religions entitled to protection? he questioned. Countering his arguments, Karnataka Advocate General Ravi Varma Kumar stressed that the state had the Constitutional obligation to provide instructions to people in way of regulation. Citing various provisions, Kumar told the Bench how important it was to protect minority rights and institutions. Primary school language should be one's mother tongue and not English, for, English is an alien language, he said. The state has the power to regulate and the right to oppose restrictions is the right of the state, Kumar said, concluding his arguments. According to 'Legal Junction' in 1982, Government of Karnataka issued an order thereby prescribing that Kannada shall be the sole first language from 1st standard of primary school itself. The order was challenged before the High Court, which held this as unconstitutional. Thereafter, in 1989, State Government, vide an order, made mother tongue' as the medium of instruction at the primary school level. Along with this, State Government made it obligatory for one to take Kannada as second language, if the same has not been chosen as the first language. The 1989 order was challenged before the Supreme Court in English Medium Students Parents Association vs. The State of Karnataka Ors, which consequently upheld it. Following this, in 1994, State Government came up with another order (1994 Order) which, after revising the policy, made the 'medium of instruction' from 1st to 4th standard in all schools recognised by the State Government as either Kannada or mother tongue. Contending 1994 order as violative of Articles 14, 19(1)(a), 21, 29(2) and 30(1) of the Constitution of India (Constitution), writ petitions were filed before the High Court. By its order, full bench of the High Court quashed the disputed clause No. 2, 3, 6 and 8 of the 1994 Order with its application to schools other than the schools run or aided by the Government. Corruption is at its very peak, with the 72 crore Miramar- Dona Paula concrete road being the latest scam. To allow corruption in Goa go unchecked we are without a Lokayukta. So that the bending and breaking of rules to favour the chosen few is not unraveled, Manohar Parrikar has systematically scuttled implementation of the Right to Information Act in the State. With the escalating crime rate Goa has become a very unsafe place with murders, rapes and assaults the order of the day. Heaps of garbage strewn is an eyesore which seems to be of no concern to this government. How does the Chief Minister defend the erratic power and water supply? To see bumpy potholed roads one does not have to go to Amethi. Goa could have been a paradise but the never ending greed of the politicians has taken this State down the tube. A five-judge Constitution Bench, headed by Chief Justice R M Lodha said that the state cannot impose a language on a child and such a compulsion could be violative of fundamental rights of the children and their parents. The order came on a batch of petitions referred to a larger bench by a two-judge bench of the SC in July last year. The matter was referred matter after noting that a two-judge Bench had in 1993 upheld the mother tongue as the medium of instruction in the primary education while deciding a bunch of petitions from Karnataka. The state had come in appeal to the apex court again after the High Court quashed its subsequent orders of 1994, inserting additional clauses besides mandating the medium of instructions. These clauses had asked schools to teach in mother tongue or Kannada, with effect from 1994-95, in all government-recognised schools in class I to IV. The order allowed only children, who had English as their mother tongue, to be taught in English medium and said that schools not complying with the directives shall be shut down. The two-judge bench had requested the larger Bench to decide the questions whether a student or a parent had a right to choose a medium of instruction at the primary education stage and also if a government’s order to impose mother tongue impacted their fundamental rights. Framing a set of five questions for adjudication by a Constitution Bench, the court also sought an appropriate decision on succinctly defining the term ‘mother tongue’ and whether the government-recognised schools will include both government-aided as well as private and unaided schools. The court sought a definition for the term ‘mother tongue’ in view of the proposition that a child may be studying at a school in a state different from his native place and will hence have a different mother tongue. The Bench also called for a decision on who would decide on the language in which a child is comfortable with if parents are held to have no right to decide the medium of instruction. XAVIERS COLLEGE MAPUSA AWARDED GRADE A The Standing Committee of National Assessment and Accreditation Council, (NAAC), Bangalore, has declared the results of the Institutions accredited by NAAC. St. Xaviers College, Mapusa, has been awarded Grade A with CGPA 3.36 on a scale ranging from 0-4. Among the 20 institutions all over the country which had applied for accreditation, 3rd Cycle, St. Xaviers College has secured 5th position. The NAAC Peer Team visited St. Xaviers College on 6th - 8th March, 2014, to validate its Self-Study Report. The team comprised of Dr. Hemixa Rao (Chairperson), Dr. S.V. Sudheer (Member Co-ordinator) and Dr. Tawnenga (Member). St. Xaviers College was earlier accredited at the Four Star level in 1999, then at the 2nd Cycle it was accredited at A level in 2007. St. Xaviers College has also been awarded the status of College with Potential for Excellence (CPE) in 2004, and the College was ranked one among the 47 colleges in India, who could meet the required parameters out of 15,000 colleges all over the country by UGC (University Grants Commission). St. Xaviers College was also awarded the Best College Award by Goa University in 2011. 6th May, 2014
[Goanet] UK Book Launch on Saturday 3 May 2014 - A Railway Runs Through by Selma Carvalho
Dear all After England's April showers that bring in the darling budding flowers of May, it was a pleasurable experience driving through the spring sunshine with the added splash of colour. The launch started on time and I take this opportunity of congratulating Selma Carvalho and her team on their research including going into the bowels of the British Library and presenting us with a salad bowl of our past in East Africa in the form of the book A Railway Runs Through which Rose and I will get down to reading before winter and no doubt will be of interest to other readers. The President of the Goan Association (UK), Mr Ravi Vaz, opened the launch, it was optimistic to hear him talk of us being around in 200 years time especially in view of today's frontpage news headlines in England's Sun newspaper Changing Face of Britain - Melting Pot UK - Third of population non-white by 2051 - MPs warned not to ignore minority vote - The Policy Exchange think tank warns politicians will have to stop treating non-white voters as if they are one huge single ethnic group. It was therefore disappointing to hear Mr James D'Souza, a representative of our learned youth and former President of the Young London Goan Society (YLGS) in his address indicate that we will in future years all be one colour. He also talked about being surrounded by Goan products in UK supermarkets, movies filmed in Goa, etc. but I cannot recall him saying that our brand Goa is being marketing by everyone else as a valuable stream of revenue because we do not market Goa ourselves. Let me explain my school of thought. Many years ago when the whole of Europe was fueding and carving up Africa and discovering the rest of the world Britain and Portugal were the closest allies even during the evil slave trade, monuments of which can be seen in Lagos, Portugal and Bristol, England. I can picture the journey of human beings shackled to wooden benches in Arab merchant ships for transportation to work in the West, no different to today's seating plan on aircrafts with the seat belt on. The only difference today is that you are free to walk about and pay for your journey including government taxes. When Britain controlled India and Portugal controlled Goa this friendship blossomed. It was during this period that our people sought opportunites to work outside Goa and favoured an education in English to avail of such job opportunities forsaking our mother tongue Konkani. This move by our people came in very handy for the British. They did not have the problem of divide and rule as our community was (and still is) divided. Money lured the Christian English speaking element of our community to be imported to Africa and today we can easily describe our people as expendable administrative coolies oiling the British administration in Africa. Those who pleased their colonial masters were elevated to what we today call top shots as looking around people in our administrative managements of various community and village organisations in the UK I can still spot coolie thinking that can only be hereditary and I am sure mirrored across our organisations around the world. It is therefore important each and everyone one of us recapture what we have lost, our identity through our language and celebrate World Goa Day for generations to come.
