If we were hitting the EIRP limits, that would be true. but it isn't the EIRP limits that we're hitting, they're limited by the out of band emmisions. The EIRP limit in UNII-1 is technically 53dBm, but because of the OOBE limits, no radios that I'm aware of can actually hit that - they all have to keep the TX power below 21db or so to stay within the limits.
