You missed the fourth requirement, "by announcement". Rule 478:
A player performs an action "by announcement" by announcing that
e performs it.
comex certainly did not announce that e was initiating a criminal case.
CFJs 1756-1757, still pending, concern essentially the same issue, of
whether announcing the initiation of a mixed-subclass CFJ (if impossible,
per CFJ 1745) can achieve the initiation of a single-subclass CFJ.
