If ODF 1.1 it is not allowed, why shall the XHTML export being fixed?
As it is an XHTML export, would not a HTML validness problem a reason for fix?
Perhaps I am getting something completely wrong, could you try to explain me the
problem in other words?

PS: You got an interesting list test document, which reveals weaknesses of the
indentation and numbering in the XHTML, this is surely an list issue (-> status
NEW).
