So I would rather accept false positives such as words in headings, poems and the like than allow arbitrary capitalization in mid-sentence. Regarding names (of either persons or companies) I would think that they need to be included explicitly in the dictionary (in uppercase) because otherwise you might as well stop spellchecking completely (almost any combination of letters makes a name in some language - I'm just thinking of Mr. Ng and Mr. Lv, whom I encountered today ...). In German, for example, there are many words that can be both noun and adjective/adverb with identical spelling except for the capitalization of the noun. I would nevertheless prefer to enter these manually in both spellings rather than allow every possible lowercase word also to be uppercase in mid-sentence (and I don't think this is already in the realm of a grammar checker!). In my opinion, a list of punctuation marks should be defined (definitely ".?!" and paragraph marks, maybe also ";:"") after which capitalization in generally allowed (or enforced?) for words that are normally lowercase. This is what even simple text editors do and with what I was always happy.
