Add to that two facts:
Lodsys, if they feel so inclined, will notify you if use multiple paid 
apps, in-app purchase, or simply an ad in your app for other apps. I know 
this from personal experience. So don't think avoiding inapp will avoid 
them. 
The main patent that they bully with expired last August.
