Do you actually own the phone? Does rooting it *cause* it to do something illegal?
Note that if you are under some weird contract with your carrier regarding the device, then that could cause limitations, for example; they give you $250 off the price of the phone if you agree to a 5 year contract -- then you don't have a "clear title" to the device until that contract expires.
