Realistically, you need a lawyer. Nobody here can offer advice on
contract law, etc.

HOWEVER.. most people seem to be ok if they read it as "if the user
doesn't gain anything by the donation (more levels, more lives,
shinier icon, ANYTHING) then its fine". (In that case it is a pure
donation, not a sale.) I don't know what that means for donator lists
or whatever though.
