Hi, I have encountered a similar issue with patching and having the 7.6.04 User Tool installed on the server you are patching, the User Tool updated the XML and the patch files would not run for 8.0 due to the 7.6.04 reference being present in the same XML - so seems like this issue is somewhat still present.
