The clock on the Pavilion renovations starts ticking when the work on the
first pavilion begins. (see the Agreement 3.3; p37) I asked at the recent
Planning Board Meeting  (when they were discussing the pavilions) if the 
work on the "temporary" First Avenue pavilion started that clock. It was no
surprise that Mr Fishman believes that because it is "temporary" he does not
consider it as starting that clock. I asked Mr Reidy to check with Mr Aaron
for an opinion on that. I am awaiting an answer.  I believe that since they
have fixed the electric, and gas and repaired the roof, and that that
building is now inhabitable and leased it is in fact renovated ( perhaps not
to our complete liking) but it is renovated and so the pavilion clock HAS
started to tick. The agreement is not clear on the definition of "completed"
but I would argue that once it has a CO it is complete for purposes of the
agreement. This means within 9 months they must begin work on another
pavilion. This second pavilion must be completed within 3 years of start.
ALL the pavilions have to be completed within 4 years from the date the work
on the first pavilion was begun. This means they should all be done by the
spring of 2008. (That assumes they started work on the first pavilion ((the
Fifth Ave Pavilion)) in the Spring of 2004; it may have been earlier. This
is a typical "timeline' issue that AP Partners must be held to.
