It had been confirmed through several layers of evidence that this game is a conglomeration of stolen code. Cloning and code theft are not exactly the same as you once stated, but this is clearly code theft, so your argument isn't even really holding any ground in this particular topic. This is code theft through and through, no matter what the definition of a clone is. And cloning of ideas is indeed fine. Space invaders clones? Sure, we have several of them that expand upon the original, take judgement Day, Alien Outback, Troopanum, etc. In fact the idea is so universal that space invaders games is a genre of its own. That is an entirely different ballpark than code theft. This game, again, was an iteration of an already existing game, using several bits and pieces of stolen code. That is what makes this game a must-go. And all things considered, this game was created by a person who has been banned from the forum for serious and repeated infractions of a similar nature. And the person who posted it is just standing behind it and so are a few others who are saying this is one of the better clones so is playing it, never mind the fact that the original developer spent countless resources developing the original game.
