I agree with you.
40F is the absolute max for the temp inside the refrigerator. 36 or so would
be a lot safer as many residential units do not have the ability to rapidly
recover from room temperature items being placed in them. 
0F would be the max I would like to see in my freezer. A -5F would be
better.
I really do not know how in the world any of us managed to survive childhood
with all that fried chicken, potato salad and other goodies prepared for
picnics. (LOL)
God Forbid, we even drank directly from the garden hose....

Let's see what others say, but I think the chill box, refrigeration
compartment, should be about 36 or 38 degrees F and the freezer around 5
degrees F or lower.  this may depend upon type of machine, some units are
really designed to have sub zero freezers but not most.

I think anything above 38 or 40 degrees in the main box is too warm.
