With or without the knowledge of the people that download the game?

It is allowed by the BOINC license (LGPL) which allows anyone to
redistribute BOINC so long as they do not change the licensing terms and so
long as they provide source code. However the users must explicitly agree
to install and run BOINC to comply with the terms of service of most
projects.  (i.e. "Run BOINC only on computers that you own, or for which
you have obtained the owner's permission.")

Anyone distributing BOINC must also provide the source code used to build
it.  Depending on their lawyer's reading of the LGPL and how BOINC is
linked into the game, they may also be required to distribute the source
code to the game.
