The compliance date for the Transactions Final Rule (August 17, 2000) is October 16, 
2002, except small health plans (not providers)whose receipts are less than $5million 
(their compliance date is October 16, 2003).  A healthcare provider who will not meet 
compliance by October 16, 2002 must file an extension.  The extension form and 
instructions for completing it are available at: cms.hhs.gov/hipaa
The Administrative Simplification Compliance Act authorizes an exception to small 
healthcare providers for the requirement to file claims electronically with Medicare 
by October 16, 2003.

Would a healthcare provider, whose receipts are less than $5 million per 
year and has fewer than 20 FTEs, be required to apply for an extension tot
 he October 16, 2002 compliance date? As a small plan/provider, who 
intitially had until October 2003 to comply, is there any reason that theyw
 ould need to submit an application for an extension?
