HOLDOUT LANDOWNER�S ATTORNEY SUES STATE, FEDS 
Holdout homesteader Jesse Hardy is stepping up his fight to stay on his land in the 
middle of an Everglades restoration project. An attorney for Hardy filed a 43-page 
lawsuit this week in U.S. District Court in Fort Myers against state and federal 
agencies planning the restoration of Southern Golden Gate Estates in rural Collier 
County. 
 
COLLIER�S STRICT RULES KEEPS SOME FROM EXTRACURRICULAR ACTIVITIES 
When Nicholas Potter signed up for marching band his senior year, he knew he wouldn�t 
be playing on the gridiron. The reason? Based on Collier County�s stricter eligibility 
policy, Nicholas can�t play in the marching band because his grades fell below a C 
average last semester. But if he lived in Lee County or elsewhere, he could have 
participated under state guidelines, which are more lenient than Collier�s. His isn�t 
an isolated case. 
 
JUDGE REBUKES SCHOOL ATTORNEY IN SCOTT TRIAL 
The plodding pace of questioning prompted a federal judge Friday to admonish a Lee 
County School District lawyer who was repetitively grilling a whistleblower on the 
witness stand.Thomas Gonzalez, an attorney for the school district, blasted questions 
at former schools safety director Ernie Scott like a machine gun, but often asked the 
same question at least twice � many times asking the questions back-to-back. 
 
NEW LMHS BOARD MEMBERS FACE CHANGING SYSTEM 
At the last meeting of his board, Lee Memorial Health System president Jim Nathan said 
he hoped for a smooth transition after the upcoming elections. There will be plenty of 
new people making that transition. Voters replaced half of the 10-member board with 
new representatives. Only one district elected both of its representatives to another 
term, and District 1 was upended as neither of the board members was re-elected.

White House Watch: So much for unity 
Uh-oh. Vice President Cheney, the scowling sidekick to the newly re-elected president, 
is throwing around the �m� word. By getting 51 percent of the vote � a �broad, 
nationwide victory� � President Bush, said Cheney, has a �mandate� to use his power to 
further his objectives. Bush, who ran a divisive campaign just as Sen. John Kerry did, 
now claims exuberantly that he has �the will of the people at his back.� There goes 
our hope for unity.

SLOT MACHINE FOES SAY LOSS AT POLLS WON�T STOP THEIR FIGHT 
Opponents of slot machines at South Florida race tracks and jai alai frontons Friday 
said passage of Amendment 4 won�t stop them from fighting to stop an expansion of 
gambling. They point to a pending court challenge, the possibility of another lawsuit 
and even going back to voters across the state to ask them to change their minds, as 
high-speed rail opponents did.
