But if the evidence is obvious??? I've never seen a situation where a guilty party has pushed for the admittance of damning evidence just so they can try to attack it, when it would serve them much better to not have the tapes admitted at all.

  I think that's a typical defense strategy - get the evidence out in
  the open so that they can discredit it before they get in the
  courtroom.
