That to me sounds like it is the same thing. I'm not arguing right vs. wrong I'm talking strictly legal. Regarding the University of Michigan opinion, the Supreme Court said race could be used as a factor, however, the point system they used to award points to somebody based on their race was not legal. The Supreme Court said that you cannot give somebody a boost simply because they are of a particular race or color, but that information can be used when picking between otherwise equal candidates. As it stood, a white applicant was being penalized for being white, and the black applicant was being rewarded for being black. A white student, that maybe have had better grades and entrance exams could still score lower than a black applicant with lower grades and entrance exams. The Supreme Court said that was not right, however, it did allow them to continue to pick a black applicant over a white applicant if all other factors were equal.
