The U.S. Court of Appeals for the 7th Circuit today ruled that the Second Amendment right to bear arms cannot be held to restrict state gun control laws until the Supreme Court rules that the right applies to the states.
http://legaltimes.typepad.com/blt/2009/06/seventh-circuit-ruling-agrees-with-sotomayor-on-second-amendment.html Interpretation: -------------------- The most conservative judges in the country (Easterbrook & Posner) said that states CAN BAN GUNS *until* the Supreme Court says they can't. And here's just one interesting tension: conservatives LOVE to uphold gun rights, but that's more of a modern fad. Conservatives forever, however, have been federalists: in other words State law over federal law. So what does a conservative SCOTUS justice do? Uphold the federal government's ability to trample on states rights OR state's right to ban guns? Verrrrryyyy interesting. ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~| Want to reach the ColdFusion community with something they want?
