Cigarettes aren't a food substance and are governed under different
laws.  You cannot, for example, sell them to minors, and buying them
is voluntary.  A warning appears on each package and if you choose to
ignore it, and they kill you, you have no one to blame but yourself.

Transfats are often included in food without any notice, so the
consumer had no warning or choice.  Unless you suggest that people
should never dine out so that they always know what they are eating,
then prohibiting transfats is not a bad idea, or at least labeling
them so the person ordering the food knew what was in it.
