Wrong again...there is a necessary and proper clause that allows Congress to
pass laws above and beyond the constitution. Just because you don't like it,
doesn't mean it doesn't exist.  The SCOTUS has also ruled, like in the case
of the NLRB,  that the federal government can overrule state law when it is
needed to provide uniformity in enforcement of laws and to ensure that the
Equality clause is properly enforced.
