Even if you can turn off the camera and microphone, the kinnect does have
to be connected at all times.  The xbox one will not function if it is
disconnected.

Here's a tidbit:

What Microsoft has not promoted, however, is the fact that you will not be
able to power on the console without first enabling the Kinect, designed to
detect both heartbeats and eye movement. and positioning yourself in front
of it.

Disturbingly, a recently published Microsoft patent reveals the Kinect has
the capability to determine exactly when users are viewing ads broadcast by
the Xbox through its eye movement tracking. Consistent ad viewers would be
granted rewards, according to the patent.




Here's another nugget:

The platform holder also said that personal data stored on Xbox One and
picked up by Kinect, like videos, photos, facial expressions and even your
heart rate, will not leave your Xbox One without your explicit permission.


Heart rate? Eye movement?

So, basically, the consumer has to trust MS's assertion that the
instruments will turn off and not share this information.

We all trust MS, right?

We'll see.  If I were a betting man, I say that the information will leave
the xbox unless you opt out.  Maybe even then.

I'll leave you with a snippet of the patent:

A content presentation system and method allowing content providers to
regulate the presentation of content on a per-user-view basis. Content is
distributed an associated license option on the number of individual
consumers or viewers allowed to consume the content. Consumers are
presented with a content selection and a choice of licenses allowing
consumption of the content. The users consuming the content on a display
device are monitored so that if the number of user-views licensed is
exceeded, remedial action may be taken.


So, if the kinect detects too many people in the room while watching
netflix, hulu, or pay-per-view, cha-ching, ring up a charge.
